Although IDK what, if anything, Mark has signed away, i.e., whether he has already signed a contract promising to transfer control of the team at some point in the future, contracts can always be breached, leaving a prospective owner with a damages claim and not control, unless the NFL’s ownership bylaws say something differently, but even then an antitrust claim could ensue.
